Menu'tje Marechal, located in 's-Hertogenbosch, is registered with the Chamber of Commerce (KVK) under number 96335424 and can be reached at info@menutjemarechal.nl . By placing an order with Menu'tje Marechal, you agree to these terms and conditions. This applies to orders placed both through the webshop and by email.
1. Applicability
1.1 These general terms and conditions apply to all agreements between Menu'tje Marechal and its customers, both private individuals and companies.
1.2 Deviations from these conditions are only valid if they have been agreed in writing.
1.3 By placing an order, the customer declares that he/she has read and agrees to these terms and conditions.
1.4 These terms and conditions also apply to business customers who place an order via e-mail or other communication channels.
2. Products & Personalized Items
2.1 Menu'tje Marechal sells hand-finished, 3D-printed oil dispensers and other kitchen-related products.
2.2 Some products can be personalized. Personalized items cannot be returned or canceled once production has begun.
2.3 Due to the handcrafted production process, slight variations in colour, finish and size may occur.
3. Orders & Payment
3.1 An order is only final after receipt of payment.
3.2 We accept payments via iDEAL, PayPal, Credit Card, Klarna and other common payment methods.
3.3 In case of suspected fraud or abuse, we reserve the right to refuse or cancel an order.
4. Delivery & Shipping
4.1 We ship to the Netherlands and Belgium via PostNL and DHL.
4.2 The estimated delivery time is 4 working days, but no rights can be derived from this.
4.3 The customer is responsible for entering the correct address. Menu'tje Marechal is not liable for delays or loss due to an incorrectly provided address.
5. Returns & Right of Withdrawal
5.1 Standard products can be returned within 14 days.
5.2 Personalized products are excluded from returns, unless there is a production error or damage upon receipt.
5.3 Return costs are borne by the customer, unless otherwise agreed.
6. Liability
6.1 Menu'tje Marechal is not liable for any damage to kitchens, countertops, or other surfaces caused by the use of our products (such as oil rings).
6.2 We are not responsible for the contents customers put in the bottles. It is the customer's responsibility to use suitable and safe liquids.
6.3 We accept no liability for indirect damage, consequential damage or loss of income as a result of a defective product.
7. Warranty & Complaints
7.1 We offer a 2-month warranty on our products under normal use.
7.2 The warranty is void in the event of improper use, damage from falling or impact, or if the bottles have been placed in the dishwasher or the exterior has been treated with water and/or detergent.
7.3 Complaints must be reported within 14 days of receipt via info@menutjemarechal.nl with clear photos of the problem.
8. B2B & Shops
8.1 For business customers (shops) we apply the same sales prices as stated in our webshop.
8.2 We offer opportunities for cooperation and resale, but deviating price agreements are only agreed in writing.
9. Privacy & Data Protection
9.1 We process personal data in accordance with the GDPR.
9.2 Customer information will only be used for processing orders and communications and will not be sold to third parties.
10. Force Majeure
10.1 Menu'tje Marechal is not liable for delays or failure to fulfill obligations due to force majeure, such as strikes, natural disasters, or supplier problems.
11. Intellectual Property & Copyright
11.1 All designs, photos, and texts on this website are the property of Menu'tje Marechal and may not be copied or used without written permission.
11.2 Violation of our copyright may have legal consequences.
12. Applicable Law & Disputes
12.1 These terms and conditions are governed by Dutch law.
12.2 In the event of a dispute, the parties will first attempt to reach an amicable resolution. If this fails, the matter will be submitted to the competent court in 's-Hertogenbosch.
